The Problem When a Qui Tam Costume Fails
Qui Tam measures are an important tool that allows an insurer to act as a private prosecutor and sue fraudsters when the state fails or refuses to prosecute an insurance fraud. But just because an insurer can bring such an action and even let the state agree and take over the case, qui tam measures are not guaranteed success.
In The People ex rel. The Department of Insurance and others v. Symons Emergency Specialties, Inc., et al., E075600, California Court of Appeals, Fourth District, Second Division (November 22, 2021) this fact came to the fore and led the insurer to defend itself against claims for attorneys' fees and damages.
A Mexican health care plan, Sistemas Medicos Nacionales SA de CV dba SIMNSA Health Plan (SIMNSA), licensed to do business on a limited basis in California, initiated a qui tam action in which SIMNSA alleged that defendants committed insurance fraud. The California Department of Insurance intervened and processed the case on behalf of the state, although SIMNSA continued to participate as a relative. The case went to trial and the jury handed down a verdict for the defendants.
After the court ruled, the defendants demanded legal fees and costs as sanctions against SIMNSA and its representatives. The defendants claimed that the district court erred in rejecting their claim for sanctions. They claim that SIMNSA and lawyers engaged in criminal conduct by prosecuting this measure while SIMNSA lacked a certificate of qualifications to conduct business within the state.
Other insurance fraud convictions
Insurance agent convicted in Burial Policy & Life Insurance [0745] 19659008] Saul Hinojosa 48, of Calipatria, California was convicted of identity theft and aggravated theft after stealing his clients' identities to write fraudulent insurance policies to collect insecure insurance policies. [19659008] Hinojosa was sentenced to 150 days in prison by release from work and to pay $ 18,252 in damages.
In February 2017, Hinojosa's employers reported an internal investigation in which they suspected that Hinojosa had written fraudulent collected funeral policies in advance. In July 2017, a consumer reported to the California Department of Insurance that they had received a new, unwanted life insurance policy produced by Hinojosa – which the consumer had previously traded with when Hinojosa was an agent with another insurance company.
