New statute requires review of sentencing

IN The People v. Howard Oliver, B317368, California Court of Appeals, Second District, Third Division (May 12, 2023) Howard Oliver appealed the sentence entered after a jury convicted him of conspiracy to defraud and defraud Medi-Cal, Medi-Cal fraud; grand theft, false and fraudulent statements, insurance fraud and four counts of tax evasion for 2012 to 2015. Oliver was sentenced to a total of seven years and eight months in prison and ordered to pay over $2.85 million in restitution.

Handling of questionable documents

False receipts and the need for confirmation of purchase are closely related, guidelines that apply to both are proposed to avoid fraudulent claims. The following guidelines are in no particular order, and it is suggested to follow a “by the numbers” approach to make the investigation most efficient and successful. This arrangement is proposed because the claimant will establish and preserve certain evidence that will be difficult for the insured to dispute as the handling and investigation progresses.

Good news from the Coalition Against Insurance Fraud

After initially pleading not guilty last year, Connie Jo Clampitt has been found guilty of over $7 million in health insurance fraud. Clampitt has since pleaded guilty, and both she and her partner, Terrance Barnard, were charged with health care fraud.

Boston man sentenced to two years in prison for benefit fraud

Fernando Mateo Valenzuela69 a Hyde Park, Massachusetts man was convicted on May 24, 2023 in federal court in Boston of using a stolen identity to fraudulently obtain government welfare benefits.

Valenzuela was sentenced by United States District Judge Leo T. Sorokin to two years and one day in prison and three years of supervised release. Valenzuela was also ordered to pay restitution of $29,051 to the Department of Employment Assistance and $7,230 to the Department of Transitional Assistance.

Yucaipa driver and wife convicted after YouTube videos of intentional crashes

Christopher Phelps40, of Yucaipa, and his wife, Kimberly Phelps, 40, was sentenced after pleading no contest to felony counts of insurance fraud, child abuse and assault with a deadly weapon. This comes after an investigation by the Department of Insurance revealed the pair caused collisions in an attempt to collect unearned insurance payouts.
