The basic test in case of bad faith is whether the insurer has unreasonably and "without proper cause" refused to compensate the insured for a loss covered by the insurance. [ Gruenberg v. Aetna Insurance Co ., 9 cal. 3d 566, 108 cal. Rptr. 480].

The adjuster should not attempt to adjust a claim, or even contact an insured, until he or she knows all that is required to protect the insurer's rights without doing anything to harm the insured's right to receive the benefits of the policy. This means that the adjuster must have carefully examined the wording of the insurance policy, the application for insurance and the loss report. The adjuster must then begin to investigate all statements completely and thoroughly.

Charges for "bad faith" can be eliminated by adjusting all statements in a detailed and basic way.

People insure for peace of mind and security. In order to protect these interests, it is important that an insurer fully investigates the possible grounds that can support the insured's claims and act quickly.
