The New York Senate on Tuesday passed a bill that would allow all workers to claim post-traumatic stress disorder.
The Senate voted 42-20 to approve SB 6373, which would be based on legislation from 2017 that allowed PTSD coverage for some first responders.
The legislation from 2017 prevented the Work Injuries Board from rejecting PTSD claims from first responders based on a finding that they were exposed to stress during the normal course of their profession.
SB 6373 would extend that protection to all workers.
“Where an employee claims mental injury due to extraordinary work-related stress that has arisen at work, the board may not reject the claim if it has actually been established that the stress was not greater than that which normally occurs in the normal work environment.”
; the proposed bill reads.The Senate last year voted 44-19 to approve the bill, and the measure died in the House. The bill was transferred to the second year of the legislative session and returned to the Senate in January.
