permissible evidence which sets out the requirements of
Community law which generally identifies nine elements needed to establish
fraud:
1. a statement of facts ;
2. its falsity;
3. its materiality;
4. the representative's knowledge of its falsehood or ignorance of the truth;
5. the representative's intention to act by the person in the man-
reasonably considered;
6. the injured party's ignorance of its falsity;
7. the injured party's dependence on the truth;
8. the injured party's right to rely on this; and
9. the injured party consequence and immediate injury.

The Frauds – Introduction
Insured persons who are intended to make fraudulent claims use many devices,
systems and objects that work to defraud insurance companies of billions
dollars in losses. In an attempt to collect large loss payments, insured
may make incorrect statements regarding material facts, conceal the actual facts and
provide false documentation. Values ​​that are claimed are heavily inflated, intentional
remarks about non-existent property, and fraud and inconsistencies
abound in fraudulent allegations. Successful handling, investigation and defense
against such fraudulent and often criminal activities requires a complete understanding
of the various elements of property insurance fraud, as well as effective
investigative methods.

There are four general types of fraudulent claim activity by which dishonest individuals
als (insured and third party claimants) engage in fraud. These activities involve the following: (1) obtaining insurance under
false pretenses by incorrectly presenting or concealing material facts in an application for
insurance, (2) creating a loss, (3) staging a loss, ( 4) exaggerate the amount of loss
and (5) incorrect presentation of the cause of the loss. Some claims involve the creation and
exaggeration of the loss and others involve all four types of fraudulent claim activity.
