(Reuters) — Tesla Inc on Monday disclosed it has received a second subpoena from the U.S. Securities and Exchange Commission over CEO Elon Musk’s 2018 tweets about taking the electric car maker private.
Tesla said in a filing that it received the subpoena on June 13. The regulator had initially sued the company in November in connection with a settlement that required the review of Musk’s tweets about material information.
The November lawsuit came days after Musk asked his Twitter followers if he would sell 10% of his Tesla stake to cover tax bills on stock options.
The company said Monday it will cooperate with authorities. The SEC declined to comment.
Musk had in 201
8 settled a lawsuit from the regulator over his private tweets by agreeing to allow company lawyers to pre-approve tweets containing material information about the company. In June, Musk appealed a judge’s refusal to terminate that 2018 deal with the SEC.
The world’s richest person, who calls himself a “free speech absolute,” has said his “funding-backed” tweet was truthful and likened himself to rapper Eminem as he tried to throw out his 2018 settlement with the SEC.
Musk is also facing a lawsuit from Twitter for canceling its $44 billion offer to buy the social media company and is now preparing for a legal settlement in a trial set to begin in October.
