Supreme Court blocks OSHA COVID-19 mandate

In a 6-3 decision today, the US Supreme Court has blocked the maintenance of the OSHA Temporary Emergency Standard (ETS) related to COVID-1

9 vaccination and testing in the workplace. The ETS, which was originally announced in November 2021 and has since faced several legal challenges, had established vaccination and testing requirements that affect employers with 100 or more employees.

This Supreme Court decision does not affect a separate mandate that is specifically applicable at medical facilities that receive Medicare or Medicaid payments, which remain in place.
