In a hearing, an administrative judge confirmed all 12 violations as serious – but not all repeated, as quoted – and assessed a total penalty of $ 58,000 for them. Wynnewood argued in his petition that "the pan-related articles would be provided because the PSM standard does not apply to the boiler", according to documents. The work secretary also requested a review and claimed that the infringements were repeated despite the fact that the previous infringements occurred when the refinery was under another business unit prior to a company's acquisition.
