Policyholder Grateful for Hurricane Michael Trial Win – Property Insurance Coverage Law Blog

Merlin Law Group's attorneys Javier Delgado and Tony Loe successfully won a jury trial over a hurricane Michael trial in Panama City, Florida, last week. When I spoke to Javier Delgado shortly after the verdict, Javier said that "the jury awarded each crown Tony asked for in his closing argument." The responding insurance company was Tower Hill.

The insurance companies are the most professional and recurring litigation in the country. Many insurance companies consider how litigation can play into a philosophy of claim and try to minimize the effect of negative publicity caused by such litigation against their customers. On the other hand, policyholders rarely consider that they will need to hire lawyers to receive insurance benefits when the insurance is sold. Maybe the insurance departments should require insurance companies to report dispute statistics to their potential customers before selling insurance?

Our client was very grateful and sent a message that she has let us share in the hope that it will inspire others with valid claims that they stands up to their insurance companies when they refuse to pay what they owe:

Dear Tony and Javier,

I hope your trips home were peaceful. Sister and I came home last night. It feels so great to be back in my world. It was beyond easy to revisit Mexico Beach in all its overwhelming battles and see that I no longer belong there. It was also troublesome to simply be "heard" by you, and then finally heard in a court of law.

I can not describe in words how grateful I am for you two. Not because it led to any financial result, but because we "did it" together ̵

1; we won. All the while I was holding a small stone that a dear friend gave me. It was representative of & # 39; David & Goliath & # 39; and something she created as a reminder to me.

Merlin Law was right about me – what happened before the two of you is nothing left in my mind – and it seems like everyone else – that it was meant to be – God's plan. I can not imagine that two other lawyers care more, work harder or present themselves in a way that made me proud to sit at their table.

Thank you.

Insurance companies are recurring players in litigation and hire very well lawyers when defending themselves. The opposite lawyer representing Tower Hill came from the Galloway law firm, a very well-established firm that defended many insurance companies in Hurricane Katrina's litigation that I was so involved in 15 years ago. Tower Hill's litigation lawyer, Todd LaDoucer, is almost out of the central role of what an insurance company would look for in a litigation lawyer. Galloway's website noted:

"In the end, military service has hampered Todd's ability to remain calm under pressure. As a graduate of the US Naval Academy and officer in three branches, Army, Navy and Marines – effective leadership is a hallmark of his character. A rigorous academic study of conquering outer space has honed Todd's intellect. His degree in aerospace engineering, with an emphasis on planetary orbital mechanics, allows him to quickly unravel and skillfully handle the most complex and intricate cases. Houston, Texas, while investigating the causes of the space shuttle Challenger crash. As a Marine pilot, Todd excelled as commander of A-6E attack jet missions. "Intruder." meticulous in planning and execution, which are qualities that are directly transferred to the exercise of law spirit and background, Todd prepared well for his subsequent legal education. He graduated on top of his Law School class at the University of Florida in 1995 and has been in private practice ever since.

Todd's education and experience combined with a relentless drive have resulted in successful results for hundreds of clients including companies, service companies , trucking companies, commercial property owners and … insurance companies. Todd works with his clients and understands that their participation and insights are invaluable for a positive outcome. ”

So how did we win? Teamwork, facts and a trustworthy customer. Javier Delgado was the main lawyer in this case. He went to great lengths to explain how so many lawyers and staff in the firm helped prepare for the trial, last-minute review, how to counter LaDoucer's last-minute arguments and in trial techniques. Javier actually noted how Etienne Font, a former non-life insurance manager who became Merlin Law Group's attorney, helped formulate the method for presenting damages in the case.

Javier also praised Tony Loe's ability to summarize and speak clearly to the jury about facts of the case. I wrote about Tony in Career Attorney Tony Loe Joins Merlin Law Group . In that post, I noted some quotes that I found in another news article about him:

  • "Law can be demanding and extremely time consuming, and I have been very blessed to have a wonderful family who have been extremely supportive on these nights and weekends when I work on my cases and try to make sure I get justice on behalf of the Broward State Attorney & # 39 ;s Office. "
  • " John F. Kennedy said, "One person can make a difference and everyone should try." "
  • " I'm really blessed: I have a wonderful family and a phenomenal job, a job I have a lot of passion for. "

Tony told me that our client's email made him proud to be a lawyer who helps policyholders.

Fortunately, the Merlin Law Group is very different from 30 years ago when I brought evidence packages to be corrected alone and with little support in cases outside the state. There was no such thing as the internet, and I would be in a law library until it closed copy cases for use the next morning at trial. Today, there really is a team behind everyone who can work all night long and share information and briefs written from afar. This helps us to even out the odds against insurance companies and their smart and competent insurance advice.

Our legal system can really be improved. Many may even criticize the US jury trial system. But I would not change it. There are many very well-meaning and talented judges, along with lawyers and citizens, who, without any fanfare or honor, voluntarily set aside time to listen carefully and make decisions to make our legal system better with limited budgets.

When we approaching Thanksgiving, I am grateful that we live in a country where people really care about justice and take action to make our system better. I am grateful to be able to help people in need with my talents. I'm grateful to work for a law firm that is so dedicated to helping policyholders achieve the justice they deserve and stand up for them against the goliaths of the insurance industry. I'm grateful for our recent victory – it was a very hard fought case that could have gone the other way.

Thought for the day

Be grateful for what you have ; you will get more. If you focus on what you do not have, you will never get enough.
