OSHA extends the comment period for vaccine mandates

On Wednesday, the Occupational Safety and Health Administration issued a 45-day extension of the comment period for the temporary standard for covid-19 vaccination and emergency testing for employers with 100 or more employees.

OSHA says that the deadline has been postponed to 19 January 2022 , to give stakeholders time to review the ETS and gather information and data necessary for comment.

The extension comes shortly after two court decisions issued this week granting a preliminary injunction on the Centers for Medicare & Medicaid Service vaccine mandate for health and healthcare staff, which in practice stops its implementation across the country pending further orders.

On Tuesday, a federal judge in Alexandria, Louisiana, ruled that government respondents did not have the authority to implement the CMS vaccine mandate, which granted the motion of the plaintiffs.

Judge Terry A. Doughty extended the scope of the injunction outside the 1

4 states included in the lawsuit to all but 10 states already during a preliminary injunction issued on Monday by the Eastern District Court of Missouri.
