NEW lawmaker approves bill to change workers' attorney fees



On Thursday, the New York Assembly passed legislation that would tie attorney's fees to the weekly workers 'compensation or a percentage of the workers' compensation.

The Democratic Sponsored Bill, S.B. 946, which passed the Assembly in a vote 109-40 on party lines, would change attorney's fees for a continuation of weekly compensation benefits for temporary total or partial disability to an amount of one week's compensation. For increases in the compensation for temporary total or partial disability, the lawyer's fee would be set at 15% of the increased compensation.

Legislation would also change the attorney's fee for loss of use or permanent facial injury awards to 1

5% of compensation in addition to the employer's or insurer's previous payments, and 15% plus an amount equal to 15 weeks' worker compensation at a New York State tax rate. Workers Compensation Board for awards for permanent partial invalidity or death benefit

The bill passed the State Senate in early June with a vote of 45-18.

If signed into law, the legislation would enter into force immediately.

Legislators in both the parish and the senate also passed a bill. to make it easier for volunteer firefighters to get workers' compensation for vascular fractures.

AB 6767, which passed the Senate on Thursday, would add vascular fractures to the list of work-related illnesses that are assumed to be compensated for volunteer firefighters.
