Excellence in Claims Handling is a community created by Barry Zalma, Esq., CFE and ClaimSchool, Inc. to help create a community of insurance professionals dedicated to providing excellence in claims management to all insured persons who file a claim to their insurer.

The professional claims manager

In the pursuit of profit, insurance companies have decimated their professional claims personnel. They laid off experienced staff and replaced them with young, untrained, unprepared people. A virtual clerk replaced the old professional claims manager. Process and computers replaced practical human skill and judgment. Money was saved by paying lower wages. Within three months after the experienced claims were fired, people’s gross profit increased. The promises from an insurance are kept by the professional indemnity person.

It is cost-effective for long periods of time to have a professional complaint staff dedicated to excellence in claims handling. A professional and experienced adjuster will save the insurer millions by resolving disputes, paying claims quickly and fairly, and thus avoiding litigation. Every insurer should provide a subscription to its claims staff.

The professional tortfeasor is an important part of the insurer’s defense against litigation from the insured against insurers for breach of contract and bad faith. Non-life professionals solve more claims for less money without either party having to involve a lawyer. When an insurer compromises with staff, profits, no matter how thin they may have been in the past, will quickly end up in negative territory. Damages and punitive damages will drain the reserves. Insurance companies will quickly question why they write insurance. Those who remain in the insurance industry will either adopt a program that requires excellence in claims management from each member of their claims staff, or they will fail.

Insurance is a company. It must change – this time for the better – if it is to survive. It must reconsider the dismissal of experienced claimants and reductions in training to save “costs”. Insurers should, if they want to succeed, adopt a program to promote excellence in claims management that can help insurers keep the promises made in insurance and avoid accusations of breach of contract and damages in bad faith in both first and third party claims.

Insurers must understand that they cannot adequately fulfill the promises they make to their insured and their obligations under fair claims procedures without a professional, well-trained and experienced claims insurer. An insurer must work vigorously and intelligently to create a professional claims department or realize that it will lose its market and all hope of profit.

Insurance personnel must be persons who:

  • can read and understand the insurances issued by the insurer.
  • understand the promises made by the police and their obligation, as insurers’ claims employees, to fulfill the promises made.
  • are competent investigators.
  • have empathy and realize the difference between empathy and sympathy.
  • understand medicine that deals with traumatic injuries and is sufficiently familiar with tort law to deal with lawyers who are equals.
  • Understand how to repair damage to real estate and movable property and the value of the repairs or property.

An insurer whose claims staff consists of people who are less than professional will be the subject of several cases of expensive, counterproductive litigation.
