The law on unintended consequences and the damage of bad faith

The concept of unintended consequences is one of the building blocks of the economy. Adam Smith's "invisible hand", the most famous metaphor in the social sciences, is an example of a positive unintended consequence.

Most often, however, the law on unintended consequences highlights the perverse unexpected effects of legislation and regulation. In 1692, the English philosopher John Locke, a forerunner of modern economists, called for the defeat of a parliamentary bill aimed at lowering the maximum allowable interest rate from 6 percent to 4 percent. Insurance is controlled by the courts, through appeal decisions and by government agencies, through laws and regulations. Compliance with appeal decisions, statutes and ordinances – different in different states – is extremely difficult and expensive.
