A public adjuster warned me that a hurricane Michael was "shaken" by a third party who allegedly purchased an AOB from an unlicensed contractor. What makes it worse is that the policyholder is confronted by the third party and a person who stays out to be a lawyer.
Do not give criminals and mobs as "shakedowns" of these villains. This is a complete shame and the authorities should be notified as soon as possible.
Entrepreneurs in Florida must be licensed. There were many unlicensed people who were contractors, roof managers, and remediation companies who were the victims of Hurricane Michael.
Here is just part of the Florida Licensing of Entrepreneurs Act:
An entrepreneurial license is required to perform certain construction work in Florida. A licensed contractor is required to affix his or her license number to any works he or she enters into. Section 489.119 (5) (b), Florida Statutes (2018). In particular, "
An entrepreneur who fails to comply with 489,119 (5) (b) sections is punished. §489.119 (5) (e), Fla. Stat. (2012). For the first time, the contractor is notified and an opportunity to correct the failure to correct after 30 days of termination will fail the contractor to penalize or quote. For all subsequent offenses, the contractor is subject to fines or quotes without prior notice and the opportunity to correct.
One of the signs that a person is unlicensed is that they have no license number in the contract or the AOB contract. If so, the contract is against the law.
What has happened is these alleged contractors who have received an AOB have left but allegedly sold their AOB to third parties who are now illegally attempting to collect by intimidating tactics and threats of disputes. So if a person states that they are a lawyer and literally accompanies the collector, ask for a card and an identification.
Don't get the victim twice. Hurricane MIchael policyholders should be cautious of scam artists and those who act as lawyers who assist in this illegal activity.
