Hunton Special Adviser Scott DeVries was quoted on August 14 in an article in Bloomberg Law entitled "More Virus Insurance Suits Could Follow as Consolidation Fails." The article discussed a federal panel's refusal to centralize hundreds of corporate lawsuits against its insurance companies regarding pandemic – related coverage. DeVries explained the statement and stated that “Insurance contracts are a matter of interpretation of state law, so I would be surprised if there were no different decisions in different jurisdictions. You can see how some policyholders may have been working on application suits, or may have been looking for ways to get out of a federal location, to avoid being vacuumed in an MDL. "And as for the panel's request for further information on the viability of four insurance-specific MDLs, DeVries explains," The language used by the judges suggests that they really take this idea seriously. Once the information about it comes in, however, a lot of challenges will be seen.
