How to File a Complaint with Arizona Department of Insurance Property Insurance Law Insurance Blog

Arizona Department of Insurance (ADI) “helps insurance consumers resolve disputes within the department's jurisdiction, and … Investigate obvious violations of Arizona law. “Specifically, ADI's Investigation Department examines consumer complaints about misconduct by insurance companies, agencies and agents, and the Market Surveillance Department examines broader corporate marketing and claims. If you believe that your claim has been delayed, unfairly rejected or otherwise handled poorly, you can file a complaint with the ADI and request an investigation.

Before filing a complaint, you should know that the ADI's authority is largely limited to enforcing the Arizona Insurance Act. It can not act as your legal representative, make facts about your claim or ask an insurance company to pay you. It can always answer questions you have about your policy or the claims process. If you file a complaint, it may also require your company to respond and review the response to see if the company or individual is complying with applicable laws, regulations and policies.

With this in mind, you can file a complaint online or by submitting the appropriate form to the ADI offices at 1

This will take you to a page with different links to different shapes. Click on "Insurance consumer, policyholder, registration / member or recipient / tortfeasor" under "Who do we have the pleasure to help" and then choose the type of insurance your complaint is about. After making the appropriate choice, you will be asked if you believe an insurance company or insurance staff has violated Arizona law. In that case, you will be sent to an online complaint form. If not, you can still call the ADI with questions about your insurance claim or insurance at (602) 364-2499 (if you live in Phoenix) or (800) 325-2548 (if you live outside the Greater Phoenix Area). [19659004] The complaint form requests information about how you contact you, your insurance (such as your company, agent and insurance number), and information about the insurance company or professional error. Once you have described why you are submitting a complaint, you have the option to attach documents that will help the ADI investigate the issue. ADI recommends that scans of your insurance, your insurance card and all correspondence be exchanged with your company or agent. You can email supporting documents to insurance.consumers@difi.az.gov.

Once your complaint and documentation has been submitted, it will be assigned to an ADI specialist. Your specialist will send a copy of the complaint to the company or agent and request a response. The specialist will review the answer along with any information you have provided to determine if there has been a violation of state laws, ordinances or your policy. If a law has been violated, ADI has the power to impose fines or sanctions on the infringing company, agency or agent. If the specialist determines that no laws have been broken, she will contact you to inform you of her decision, explain how she achieved it and discuss other possible solutions with you.
