How to File a Complaint to the Michigan Department of Insurance and Financial Services | Real estate insurance coverage law blog



The goal of the Michigan Department of Insurance and Financial Services (DIFS) is to ensure that "[a] will become Michigan consumers… Have access to insurance… Provided by companies that treat them fairly." 1 DIFS Office of Consumer Services helps achieve this goal by investigating consumer complaints about errors from insurance companies, agencies and agents.If you think your claim has been delayed, unfairly denied or otherwise mishandled, you can leave file a complaint to DIFS and request an inquiry

Before filing a complaint, DIFS encourages consumers to first try to resolve disputes directly with their insurance company.DIFS can not act as your legal representative, not establish facts about your claim or order an insurance company However, it may answer questions you have about your policy or claims process. If you file a complaint, it may investigate a if your company, adjuster or agent complies with all applicable laws, regulations and policies.

If you have already tried to resolve the issue with your company and failed, you can file a complaint online on the DIFS website or by faxing your completed form to 51

7-284-8837; via email to difscomplaints@michigan.gov; or email PO Box 30220, Lansing, MI 48909-7720. The complaint form requests your contact details, the name of the insurance company, the agency or agent involved and the applicable insurance or claim number. It then asks about the cause of your complaint and a description of your problem. Once you have described why you are submitting a complaint, you will have the opportunity to attach documents that will help DIFS investigate the problem. DIFS recommends that you attach copies (not originals) of your insurance, your claim and any correspondence exchanged with your company or agent with your complaints.

After submitting your complaint and its documentation, DIFS will contact your insurer and request a written response to your complaint. Once a response has been received, DIFS will review it to ensure compliance with all applicable laws and regulations. It then sends copies of all correspondence from the inquiry together with a letter explaining the results. If your company, agent or adjuster has violated the law, DIFS has the power to impose fines or penalties. If DIFS discovers that no laws have been broken, it will explain how it made that determination and describe other options that may be available to you.
