Physicians have established their own codes of ethics with respect to an IME and are required by these codes to report their findings fairly and accurately. The American Board of Independent Medical Examiners has published the following Code of Ethics:
- Be honest in all communication.
- Respect the rights of graduates and other participants, and treat these individuals with dignity and respect.  An independent doctor has a contractual relationship with the unit that employs them, but no previous relationship with the subject of the examination. And this contractual relationship is often independent of, if not negative, the subject's relationship to the examiner's employer. Introducing a categorical duty of care that runs from the independent physician to the subject would put the examiner in an unsustainable position, if not create a direct conflict of interest. [ Kirk v. Anderson (Utah Supreme Court, 2021)]
The adjuster who follows the rules profiled by the American Board of Independent Medical Examiners, similar to those set by the International Association of Special Investigation Units (IASIU), should receive appropriate independent medical advice. providing training and education for insurance investigators; develop greater awareness of the problem of insurance fraud; encourage high professional standards of conduct among insurance investigators;
When an IME is retained, the insurer should inform the IME of its obligations in writing as follows:
You have been requested by ABC Försäkringsbolaget to conduct an independent medical examination of the the injured party and report to me regarding the injuries, the current condition, your prognosis and your evaluation of any further treatment that the injured party needs. To assist you in this regard, we enclose as completely as possible all medical records from the applicant that we know of. of the injured party listed above was caused by the accident and, in that case, the extent of the damage so that we can correctly evaluate his claim against our insured. We expect your review to provide the Company with sufficient facts to assist the Company in its obligation to make a decision regarding the claim.
