EEOC's updated covid technical assistance includes retaliation



The US Equal Employment Opportunity Commission said on Wednesday that it has updated its covid-19 technical assistance to include more information on employers' retaliation in pandemic-related employment situations.

former employees are protected from reprisals from employers for asserting their rights under any of the EEOC-enforced anti-discrimination laws.

This is Title VII of the Civil Rights Act of 1964, as amended by the Pregnancy Discrimination Act; the Equal Pay Act of 1963; the law on age discrimination in employment from 1967; Americans with Disabilities Act of 1990; Civil Rights Act of 1991; Sections 51 and 505 of the Rehabilitation Act of 1967; and the Law on the Non-Discrimination of Genetic Information of 2008.

Other important updates include that protected activity can take many forms, including filing a discrimination fee; complain to a supervisor about harassment of employees; or request accommodation for a disability or a religious belief, practice or observance, regardless of whether the request is granted or denied.

The EEOC said the updates also include that the ADA prohibits interference in the individual exercise of rights under the law, in addition to retaliation for protected activities.

The EEOC stated in its statement that the updated technical assistance supports the EEOC's participation in an intergovernmental initiative to stop reprisals against workers exercising their protected labor and employment rights.
