The range of punitive damages has worked to make several millionaires of many insurance criminals who convince insurance companies to settle down rather than take a chance on trial. Insurers pay claims that they believe they are not guilty of because they are afraid – regardless of the benefits of their position – of being judged punitive in a bad faith act.
The fear is not well placed if the suspected fraudulent allegation or uncovered loss is denied on the basis of a fair and thorough investigation, an intelligent examination of facts when they relate to the policy formulation and a reasonable application of the Jurisdiction Act. If an insurer, after a fair and thorough investigation, considers that a fraud is attempted or that the loss is not covered by the insurance form, the dispute between the insurer and the insured is a non-damage matter and the insured is limited to recovering contractual damages.
If the insurer has done its job properly before rejecting a claim, it should never be held liable for violating the union of good faith and fair trade. Accusations of damages and criminal damages should be eliminated as a matter of law.
Guebara v. Allstate Insurance Co. 237 F. 3d 987 (9th Cir. 2001), Allstate believed, from his investigation, that Guebara had attempted fraud. The ninth district court held:
The actual dispute in this case was not purely factual. The actual dispute over the content requirements was based on factual evidence – three expert opinions, inconsistent testimony from Guebara and her witnesses and desperate economic circumstances. However, the real dispute over the structural claim was based on the language of fraud in the policy and on an unresolved issue in California's insurance laws.
