A life insurance contract purchased with the intention of benefiting persons without an insurance interest in the life of the insured violate New Jersey public order, and such a policy is void from the outset. [ Sun Life Assurance Co. of Canada v Wells Fargo Bank (NJ, 2019)]
When a policy is declared "invalid" by insurers, the most common reason is that the insured has violated a condition in the police, which actually loses the insurance. "Confiscation" is defined in Webster's 3rd International Unabridged Dictionary as "loss of any right, privilege … as a result of a … violation of conditions or other act." In general, if the insurer accepts unearned premiums from the insured at the time of confiscation or annulment with knowledge of facts indicating confiscation, the insurer waives its right to defend on that basis.
When an adjuster decides that an insurance policy should be declared invalid based on policy language similar to the language of ordinary fire policy, he or she must coordinate with the insurance department so that insurers are aware of the act and do not inadvertently refrain from a viable defense. The adjuster should be sure that a copy of the letter stating that an insurance policy is invalid is placed in both the insurance file and the claim document.
The insured did not make "[a] merely supervision or honest mistake" Rather, he made a knowingly misconception about an essential fact. Despite the fact that, despite the fact that the incorrect presentation was not made at the conclusion of the insurance contract, the court considered that the insurer was entitled to declare the insurance invalid. they insured to let the insurer trust it to its detriment from the beginning.
