Deadline for vaccine mandate threatens employers despite challenges

"Employers need to plan on not postponing dates," Pearce said, noting that there are many avenues for either parts of or a revised ETS to prevail.

"The temporary emergency standards serve as the basis for permanent rules," he said. "I do not think OSHA will really look past the next few months, but they will later decide whether to withdraw this, issue a new rule, try to make it permanent with changes."
