Court confirms stay on vaccine mandate; OSHA is preparing for ratification

The 5th U.S.A. The Circuit Appeals Court of Appeals in New Orleans on Friday confirmed its earlier interim injunction against the implementation or maintenance of the Occupational Safety and Health Administration's interim emergency standard requiring covid-19 vaccination and testing.

The court found that the ETS was "under-inclusive" and "overbearing" because it did not consider covid-19 to be "more dangerous for some employees than for other employees."

This week, the Labor Department prepared a ratification of the rule, in which Labor Minister Martin Walsh writes: "With great caution, in order to avoid doubt as to its validity, I have independently evaluated the interim final rule and the basis for adopting it." trying to confirm and ratify the rule. The ratification is scheduled to be published in the Federal Registry on Thursday.

"In my considered and independent assessment, the interim final rule was and remains necessary to protect unvaccinated employees from the serious danger of exposure to the virus that causes covid- 1

9," he wrote. Secretary Walsh.

The Court's decision has no effect on previous vaccine mandates valid in healthcare settings or on federal contractors and subcontractors.
