When a construction contract, like any other contract, is unambiguous, the intention of the parties can be determined exclusively from the contract, and it is the duty of the court – not the jury – to state its meaning.
Construction contracts are governed by the same rules as all other contracts. When a court is called upon to interpret a construction contract, its terms take on their usual and generally accepted meaning with the court working to enforce the intention of the contracting parties unless the contract itself gives the contract a special meaning.  A construction contract should always be written. It should, like all other contracts, describe in detail the obligations and obligations of the contracting parties. It should communicate the scope of the work to be carried out and the extent to which each party is involved in the various aspects of the project.
Contracts serve as a way to document the services and assets to be exchanged during a project. The contract is important not only to complete the deal in the minds of the construction project, but also to define the execution of the work and can even determine who bears the tax burden.
A basic construction contract is negotiated by the parties and will be interpreted according to the normal rules of interpretation.
The construction contract is the most effective way to avoid disputes between the owner and the builders involved in the construction project. Regardless of whether standardized forms are used or whether the agreement is written according to the parties' specifications by an experienced construction lawyer, the contract is crucial for a successful construction effort.
