The California Labor Commissioner’s Office has fined several staffing companies and a couple of meat processors a total of $ 3.8 million for failing to inform 3,476 temporary employees of their available covid-19 supplemental paid sick leave.
Three staffing companies – Viking Staffing CA LLC, Human Bees Inc. and Marcos Renteria Ag Services Inc. – and joint employers Foster Farms LLC and Foster Poultry Farms were found to have violated state safety regulations for covid-19 intended to keep sick workers at home.
According to a statement from the Labor Commissioner’s Office, investigators found that the Foster Poultry Farm processing plant in Livingston experienced covid-1
9 outbreaks and failed to follow protocols.The investigation included a review of payroll records, which found that staffing companies referred to hired staff to fill in for permanent employees affected by covid-19 outbreaks at the factory, but failed to inform temporary staff about their rights to supplementary paid sick leave.
The Labor Commissioner’s Office found that the staffing companies Foster Farms LLC and Foster Poultry Farms were jointly responsible for the infringements.
The law on supplementary paid sick leave came into force this year and provides covered employees with up to 80 hours of covid-19-related paid leave, with up to 40 of these hours for isolation and quarantine, among other benefits.
