Illinois lawmakers are now considering bills that clarify causal links to workplace injuries and limit cumulative trauma injuries and provide financial support to families of health care workers who die from COVID-19.
Introduced Monday, H.B. 3556 would clarify that an "injury occurs from and during employment only if the accident substantially caused or contributed to both the resulting condition and disability." The bill also states that “an injury does not occur due to and during employment if (1) the risk or risk was not associated with employment and was a danger or risk to which the public is also exposed, (2) the injury did not occur at any time and place and in circumstances reasonably required by the employment, or (3) the disability was due to a personal risk.
The bill also limits the conditions for repeated or cumulative trauma compensably and "provides that gradual deterioration or progressive degeneration of the body caused by aging cannot be compensated as repetitive or cumulative trauma."
Also introduced Monday, HB 381
Both bills were sent to a regulatory committee.
