Michigan lawmakers will consider a bill that would end the legal immunity granted to employers who comply with workplace safety regulations and whose employees are affected by COVID-19.
HB 6173, to be introduced on Tuesday, would end the immunity granted in the 2020 legislation that states “an employer is not responsible … for an employee’s exposure to covid-19 if the employer worked in accordance with all federal, state and local laws, rules and regulations, executive orders and agency orders related to covid-19 that had not been denied legal effect at the time of exposure. ”
The 2020 Act also stated that “(an) isolated, negligible deviation from strict compliance with such laws, regulations, ordinances, executive orders and agency orders that are not related to the employee̵
7;s exposure to covid-19 does not deny an employer immunity.”The latest bill would not apply to an exposure to covid-19 that occurs after July 1, 2022.
