A lawsuit against a Colombian airline over an injury caused by a drinks cart veered off course when the plaintiff’s attorney, instead of poring over legal volumes for case law, used a chatbot to find cases to cite in his legal brief.
And Avianca Airlines lawyers later discovered that the cases did not exist.
As reported by the New York Times, a US District Judge upheld the false citations in a court filing regarding sanctions for the plaintiff’s attorney: “Six of the filed cases appear to be false judicial decisions with false citations and false internal citations.”
The plaintiff’s attorney admitted in affidavits that he had used OpenAI’s chatbot for his research and to verify the cases he asked the chatbot if it was lying, according to the article.
He later testified that he “deeply regrets having used generative artificial intelligence to supplement the legal research conducted herein and will never do so in the future without absolute verification of its authenticity,”
