T T The Supreme Court of Colorado refused to apply the notice-prejudice rule to a policy provision prohibiting the insured from making voluntary payments on, or regulating, a claim without the insurer's consent. The court reasoned that "the clause on non-voluntary payments in the current agreement actually applies to the insurance cover." not incur any cost without prior approval except at its own expense. Indiana law provides that an insurer is not liable when an insured violates a voluntary payment clause by failing to obtain the insurer's consent before incurring the cost. ”

On the other hand, the North Carolina Court of Appeals requires a substantial prejudice claim for insurance disputes. concerning the clause on voluntary payments in a liability insurance. A school system made a claim of $ 49,200 against the insured roof contractor for water damage to the school's property in the building. The insured is alleged to have agreed with the school system to be responsible for the payment of the water damage claim before the insurer's decision on reporting the damage. At some point, the insurer denied coverage for the claim. The insured submitted a declaratory judgment to determine whether the claim was covered.

If the insured has violated the clause on voluntary payments in the insurance but the insurer has not shown that the insured's action prevented the insurer from investigating or trying a claim, summary judgment of the insurer shall be refused. When the court made its decision, the court said:

[W] e conclusion that an insurer must show prejudice if the insured has violated the clause on voluntary payments in the parties' insurance contracts. The defendant has not shown that the plaintiff's actions prevented the defendant from investigating or examining the claim. the rights of the insurer in the states that require the presentation of prejudice.

The terms are an important part of any insurance contract. Terms such as the condition of voluntary payments, the condition of rapid reporting and the condition of proof of loss will invalidate coverage in most states. In some states, the courts will apply the rule of preliminary ruling, so it is important that before making a decision on a breach of a material condition, consult a competent insurance lawyer in the state where the damage occurred, before deciding on the claim and whether the loss is in a permit applying the rule of notice of prejudice, if there was actual damage as a result of the infringement.
