If the real or personal property of the insured is damaged by a risk of loss of insurance against the damage process must start as soon as reasonably practical.
It is the insured's duty to notify the insurer immediately as soon as a loss occurs that a loss has occurred, the type of loss, the date and time of the loss and how to contact the insured to begin the injury research.
When the loss notice is received, the insurer will assign a claim management to initiate an investigation of the loss and work with the insured to prove the claim to the insurer.
What is an adjustment?
An "adjuster" or "insurance adjuster" is, by statutory definition, a person, partner or company that undertakes to ascertain and report the actual loss of the insurance object due to the insured danger. By issuing insurance, insurance companies create a contractual obligation to pay their insured valid claims. Insurance companies understand that almost all insured cannot prove the cause and extent of the loss without assistance. Therefore, the insurer sends a person with special knowledge ̵
The adjuster is also present to distinguish the valid claim from a claim for which the insurance company is not liable under its insurance.
Some policies specifically state that the applicant must use his or her own assessment to estimate the amount of loss and that the assistance of an insurance adjuster is "only satisfactory" – the applicant must still submit proof of loss within 60 days of the loss, even if the adjuster does not provide the form or help the insured complete the proof of the loss.
Generally "[w]an insurer shall notify its insured in writing of its desire that proof of loss under a fire insurance policy d provide a suitable form for such proof, failure to insure to submit proof of loss within 60 days of the receipt of such a message, or within any length of time specified in the message, is an absolute defense to a policy action "[ Stopani v Allegany Co-Op Ins . Co., 83 AD3d 1446, 920 NYS2d 559, 2011 NY Slip Op. 2588 (NY App. Div., 2011)]
Since the invention of the adjuster more than a century ago, it is the first person from the insurer that the insured encounters when he or she suffers. A first part of the property loss is the adjuster. The claims adjuster was invented to compare the claims process and to be sure the insured receives the promised compensation and conduct a full and thorough investigation to avoid fraudulent claims.
Every modern indemnity works with the knowledge that it is his or her duty to assist the insurer in its duty to fulfill the promises made by the insurance policy and to assist the insured in submitting his or her insurance to the insurer.
An insurance adjuster is a person who works with insurance business. The first party property insurance adjuster limits his business to investigating and adjusting claims on first party property such as fire, lightning, windstorm, hail, theft etc.
An insurance adjuster is an agent of the company and his powers and authorities are primarily coextensive with the company entrusted with his or her care. The adjuster's duty is to determine and determine the amount of any claims, losses or damages payable under an insurance contract and / or settle such claims, losses or damages. The act of an adjuster within the obvious scope of his authority is binding on the company without prior notice to the insured on the limitations of his or her powers.
