The insured can meet a lawyer representing the insurer in two circumstances:
- If the insured has been sued by a third party, the insurer will retain a lawyer to defend the insured at the insurer's expense. The advisor will meet with the insured and work to present the most effective defense for the suit. The insured usually meets with the damages council in a situation where the insured is in a car accident and a third party is suing him or her for damages that have occurred in the accident.
- If there is a problem with coverage or with the extent of the damage. , if the insured retains a lawyer to present his claim, or if fraud is suspected, the insurer will retain a lawyer to protect his interests. Lawyers representing insurers in such situations are often referred to as "Coverage Counsel." Coverage advice will usually deal with the insured's personal lawyer.
The insured can consult with the insurance company if an investigation under oath is required by the insurer to resolve coverage issues identified in the investigation of a first-party protection. In that case, the insured must, as a condition of the insurance, appear before the damages council and testify.
The insurance survey under oath ("EUO") is a formal interview approved by an insurance contract. It is taken under the authority provided by a condition of the insurance contract which compels the insured to appear and give a hard testimony about the claim of the insurer or find that his or her claim is rejected for breach of a condition. A notary and a certified stenographer reporter are always present to take the oath to the interviewee and record the entire conversation.
