An "adjuster" or "insurance adjuster" is, by law, an individual, co-partnership or company that undertakes to determine and report the actual loss to the insured object due to the risk insured against. Insurance companies create, by issuing an insurance, a contractual obligation to pay their insured's valid claim. To do this, insurers understand that the insured cannot prove the cause and extent of the loss without assistance. Therefore, the insurers send out a person with special knowledge – the adjuster – to distinguish facts from fiction, determine the cause and origin of the alleged loss and determine sufficient information for the insurance company to be able to determine the amounts necessary to replace the insured promised by the insurance . The adjuster is also present to distinguish the valid claim from a claim for which the insurance company is not liable under its insurance.
Some insurances specifically state that the applicant must use his own judgment to estimate the amount of the loss and that the assistance of an insurance adjuster is a "courtesy" – the plaintiff must still send proof of loss within 60 days of the loss even if the adjuster does not provide the form or help you fill it out. As a general rule, "[w] when an insurance company notifies its insured of its request for proof of loss under a fire insurance policy and provides an appropriate form of such proof, if the insured does not submit proof of loss within 60 days of receipt of such notice, or within a longer period of time specified in the notice, is an absolute defense against a policy action ”[ Stopani v. Allegany Co-op Ins. Co ., 83 A.D.3d 1446, 920 N.Y.S.2d 559, 2011 N.Y. Slip Op. 2588 (NY App. Div., 2011)]
