The insurances generally distinguish between a claim and a suit by forcing the insured to report both claims and suits. Courts usually recognize that there is a difference. A claim can be made without an application being submitted. Only a statement from a plaintiff to an insured that he or she was injured due to the insured's negligence is sufficient to make a claim. A "lawsuit" on the other hand usually requires filing a complaint with a competent court that responds to the charges in the lawsuit.
Most insurances require the insured to immediately or "as soon as possible" report a claim to the insurer even if there is no such thing. By demanding that the insurer has the ability to investigate and try to resolve claims before expensive disputes begin.
Liability insurers prefer claims made to limit their exposure. Under such insurances, the insured person or entity must report a claim for as long as it is made during the insurance period or an extended reporting period or lose coverage.
Claim insurance differs from traditional "event" – based insurance is based primarily on the extent of the risk they insure against. For insuring insurances, coverage is provided only where the document that gives rise to coverage is discovered and noticed by the insurance company during the insurance period.
